DescriptionThis article, after briefly exposing the two main theses about the nature of the nullity contemplated in Law No. 19,496 regarding unfair terms, examines whether the regime of absolute nullity exhibits the dysfunctions accused by a certain sector of the doctrine. An attempt is made to show that all objections to the consistency and functionality of the application of said regime are defeatable and that they do not justify the construction, through interpretation, of a special regime. It is postulated that the regime of absolute nullity, correctly understood, is not only functional, but is also more protective than an alleged, incomplete and uncertain special regime.en-US
DescriptionLuego de una exposición sintética de las dos principales tesis acerca de la naturaleza de la nulidad contemplada en la Ley n.° 19496 respecto de las cláusulas o estipulaciones abusivas, se examina si el régimen de nulidad absoluta exhibe las disfuncionalidades acusadas por parte de la doctrina. Se intenta mostrar que todas las objeciones a la consistencia y a la funcionalidad de la aplicación de dicho régimen son derrotables y que no justifican la construcción, por vía interpretativa, de un régimen especial. Se postula que el régimen de nulidad absoluta, rectamente entendido, no solo es funcional, sino que, además, es más protector que un pretendido, incompleto e incierto régimen especial.es-ES
