Among the issues related to the law of torts, without a doubt one of the most controversial is the referring to the claim for compensation for the consequences derived from marital infidelity. The Supreme Court of Justice of the Nation recently issued an interesting precedent in the sense of denying the origin of the compensation for dam-ages derived from this assumption, attentive, in general terms, to the right to free development of the personality and that fidelity sexuality is a moral duty, so the spouses cannot be coerced. The issue raised by the Supreme Court is analyzed from precisely these two aspects: the limits to the right to free development of the personality and the consequences of the non-observance of these moral duties. We conclude that the arguments of the sentence analyzed are not convincing and we propose new lines of analysis of the problem.Dentro de los temas relativos al derecho de daños, sin duda uno de los más polémicos es el referente a la reclamación de indemnización por las consecuencias derivadas de la infidelidad conyugal. La Suprema Corte de Justicia de la Nación reciente-mente se pronunció en una interesante sentencia en el sentido de negar la procedencia de la indemnización por daños derivados de este supuesto, atento, en términos generales, al derecho al libre desarrollo de la personalidad y a que la fidelidad sexual es un deber moral, por lo que no se puede coaccionar a los cónyuges a su cumplimiento. Se analiza el tema planteado por la Suprema Corte precisamente desde estos dos aspectos: los límites al derecho al libre desarrollo de la personalidad y las consecuencias de la inobservancia de esos deberes morales. Concluimos que no resultan convincentes los argumentos de la sentencia analizada y proponemos nuevas líneas de análisis del problema.
