The article exposes the problems present in Mexico when surrogacy arrangements are signed in a context of the legal void, and the consequent violations of human rights of people willing to procreate, surrogate mothers and the best interests of children, due to the absence of mechanisms that supervise and inspect the actions of assisted reproduction clinics that act as intermediaries in the contractual relationship. In this sense, the criteria set forth by the Inter-American Court of Human Rights regarding the scope, limits, and state duties that emanate from the human rights at stake will be re-viewed and analyzed, in order to present a prevention strategy that allows the good practice of gestational surrogacy in the country.El artículo expone la problemática presente en México al celebrarse acuerdos de gestación por sustitución en un contexto de vacío legal, y las consecuentes violaciones a los derechos humanos de las personas con voluntad procreacional, la mujer gestante y el interés superior de la niñez, debido a la ausencia de mecanismos que supervisen y fiscalicen el actuar de las clínicas de reproducción asistida que fungen como intermediarias en la relación contractual. En ese sentido, se revisarán y analizarán los criterios expuestos por la Corte Interamericana de Derechos Humanos acerca de los alcances, límites y deberes estatales que emanan de los derechos humanos contrapuestos, a efecto de presentar una estrategia de prevención que permita la buena práctica de la gestación subrogada en el país.
