Through Dilthey’s Philosophy of Life, in this essay the theories of Kelsen and Schmitt willbe compared, noting, as a fundamental likeness between them, the pretension of purity, legal in the firstone and political in the latter. As the most noticeable difference, we find the position of the Constitution’sguardian: the Constitutional Court and the Führer, respectively. As a conclusion, this essay tries to retainthe positive aspects of both theories: judicial constitutional control (Kelsen) and popular participation(Schmitt)Mediante la filosofía de la vida de Dilthey, en este trabajo se comparan las teorías de Kelseny Schmitt, destacando, como semejanza fundamental entre ellas, la pretensión de pureza, jurídica en elprimero y política en el segundo y como diferencia más señalada la del guardián de la constitución:el Tribunal Constitucional y el Führer, respectivamente. Como conclusión intenta conservar los aspectospositivos de ambas teorías: el control constitucional judicial (Kelsen) y la participación popular (Schmitt)
