On 29 March 2023, Law 7/2023 on the protection of animal rights and welfare was published. It appears to be a very innovative law, which takes into account animals as sentient beings and which, in addition, will allow for greater responsibility from owners to ensure better living conditions for them. However, not all animals enjoy the protection and respect offered by this law: a distinction has been made between dogs that are destined to keep humans company and those that are used to assist them in hunting. In this way, the new law limits itself to pointing out that the fields excluded from it are protected by the current European, state and regional regulations. Therefore, the aim of these pages is to find out whether hunting dogs are really protected by any of the aforementioned regulations or if, on the contrary, there is a protection gap. The relevance of the hunting sector in our country will also be noted, and the arguments put forward to exclude hunting dogs from the new regulations will be identified. Then, finally, we will discuss the possible unconstitutionality of the regulation, based on the difference in treatment offered to dog owners who carry out hunting activities, which suggests the presence of a possible violation of the principle of equality between Spanish citizens, enshrined in Article 14 of the Constitution.El 29 de marzo de 2023 se publicó la Ley 7/2023, de protección de los derechos y el bienestar de los animales. Aparece como una ley muy novedosa, que tiene en cuenta a los animales como seres sensibles y que, en más, permitirá una mayor responsabilidad de los propietarios para asegurarles unas mejores condiciones de vida. No obstante, no todos los animales gozan de la protección y el respeto que ofrece esta norma: se ha establecido una diferencia entre aquellos perros destinados a hacer compañía al hombre, y aquellos que son utilizados para asistirlo en la cacería. Así, la nueva ley se limita a señalar que los campos excluidos de la misma, quedan protegidos por la normativa vigente europea, estatal y autonómica. Por tanto, el objetivo de estas páginas es averiguar si realmente los perros de caza se encuentran protegidos por alguna de las normas mencionadas o si, por el contrario, advertimos una laguna de protección. Asimismo, se constatará la relevancia del sector cinegético en nuestro país, y se identificarán los argumentos que han esgrimido para excluir a los canes cazadores de la nueva norma. A continuación, y por último, expondremos la posible inconstitucionalidad de la norma, sobre la base de la diferencia de trato ofrecida a los propietarios de perros que desarrollan la actividad cinegética, lo que permite sugerir la presencia de una posible vulneración al principio de igualdad entre los ciudadanos españoles, recogido en el artículo 14 de la Constitución.
