This work is a brief analysis of the principle of justified mutability of the regime of benefits in the record of marriage, incorporated into the Brazilian legal system with the advent of the Civil Code of 2002. It is discussed for the concretization of the application of the principle: it is through judicial means ou administratively, through public deed.Este trabalho faz breve análise do princípio da mutabilidade justificada do regime de bens na constância do casamento, incorporado ao ordenamento jurídico brasileiro com o advento do Código Civil de 2002. Levanta-se a discussão para a concretização da aplicação do princípio: se por via judicial ou administrativamente, através de escritura pública.
