In this study we propose to conceptually delimit the undercover agent and analyse within the criminal procedural system its fit, its nature and its application projection within the Spanish criminal procedure. However, this research would be mutilated if the consequences for the State Security Forces and Corps, and in particular the Judicial Police, of the use of this figure were not analysed in the same way.En el presente estudio nos proponemos delimitar conceptualmente al agente incubierto y analizar dentro del ordenamiento procesal penal su encaje, su naturaleza y su proyección aplicativa dentro del procedimiento criminal español. Sin embargo, quedaría mutilada la presente investigación si no se analizasen, del mismo modo, las consecuencias que para las Fuerzas y Cuerpos de Seguridad del Estado y, en particular, la Policía Judicial, comparte el uso de esta figura.
