En la actualidad, la delincuencia organizada representa uno de los mayores retos para los Estados. Debido a ello, las autoridades han creado técnicas extraordinarias de investigación criminal para combatirla. Entre éstas se encuentran las operaciones encubiertas. En este sentido, el presente artículo abordará la temática de las operaciones encubiertas en el marco de la delincuencia organizada. Asimismo, se emprenderá un examen de la figura del agente encubierto como principal protagonista de dichas operaciones. Finalmente, se concluirá que éstas deben aplicarse únicamente a investigaciones que se encuentren relacionadas con la delincuencia organizada, y bajo un estricto control judicial.At present, organized crime is one of the greatest challenges for States. Thus, the authorities have created extraordinary techniques of criminal investigation to combat it. Among these are undercover operations. This paper will address the issue of undercover operations in the context of organized crime. In addition, a review of the undercover agent as the main protagonist of such operations will be undertaken. Finally, it will be concluded that these should apply only to investigations that are related to organized crime, and under strict judicial control.
