Description	En los últimos años, la filosofía italiana está teniendo un papel central en el pensamiento contemporáneo. Situada entre la biopolítica y la teología política, proporciona una lectura otra de la modernidad a través de los conceptos vida-historia-política. El presente texto se enmarca dentro de la llamada Italian Theory para exponer sus dos posibles vías jurídicas: destituyente e instituyente. A partir del pensamiento de Giorgio Agamben y Roberto Esposito, se plantearán unas líneas generales de una filosofía del derecho a través de la Italian Theory.	es-ES
Description	In recent years, Italian philosophy has been playing a central role in contemporary thought. Situated between biopolitics and political theology, it provides a different reading of modernity through the concepts of life-history-politics. The present paper is framed within the so-called Italian Theory to expose its two possible juridical paths: destitute and institute. From the reflections of Giorgio Agamben and Roberto Esposito, this paper will present a general approach to a philosophy of law through the Italian Theory.	en-US
