DescriptionThis essay is an attempt to use some of the concepts of legal theory to interpret the emergence of the modern state. Starting from Kelsen’s and Weber’s definition of the State, I argue that the modern State or Sate stricto sensu is a form of political power that is exercised in the form of law and justified with the use of concepts like sovereignty and I try to show that these concepts, that are constitutive of the State, emerge as the result of constraints arising from the hierarchy of norms and weighing on legal argumentation.en-US
DescriptionEste ensayo es un intento de utilizar algunos de los conceptos de la Filosofía del Derecho para interpretar la emergencia del Estado moderno. Comenzando por las definiciones del Estado de Kelsen y Weber, sostengo que el Estado moderno o Estado stricto sensu es una forma de poder político que resulta ejercida mediante la ley y justificada con el empleo de términos como soberanía e intento mostrar que tales conceptos, constitutivos todos ellos del Estado, nacen como resultado de las restricciones emanadas de la jerarquía normativa y con apoyo en la argumentación jurídica.      es-ES
