DescriptionThe text analyzes the project known as “Sernac te protege” in the part that refers to the protection of the dignity of the consumer. The technique used consists of incorporating into the standard that regulates security and surveillance systems, a positive duty and another of abstention related to dignified treatment. Additionally, it adds the statement that the category of vulnerable consumer could serve as an element of adaptation of the indicated imperatives. The tenor of the subsections that are intended to be incorporated hints at the drafter’s intention to grant broad validity to the imperatives it contains. However, the location chosen, as well as some expressions used in the configuration of the rules, could put this breadth at risk.en-US
DescriptionEl texto analiza el proyecto de ley conocido como “Sernac te protege” en la parte que se refiere al resguardo de la dignidad de la persona consumidora. La técnica utilizada consiste en la incorporación en la norma que regula los sistemas de seguridad y vigilancia, un deber positivo y otro de abstención relativos al trato digno. Agrega, además, la enunciación de que la categoría de consumidor vulnerable podría servir de elemento de adecuación de los imperativos señalados. Aunque el tenor de los incisos propuestos, insinúa la intención del redactor de conferir una vigencia amplia de los imperativos que contiene la ubicación escogida, así como algunas expresiones utilizadas en la configuración de las normas, podrían poner en riesgo dicha amplitud.es-ES
