This paper analyzes the judgment pronounced by the Supreme Court, dated January 4, 2021, in case roll n ° 5493-2020, entitled “Z. with Talcahuano Health Service”, referring to the importance of the function that complies with the court in controlling the correctness of the procedure as a way of guaranteeing due process of law.En el presente trabajo se analiza una sentencia pronunciada por la Corte Suprema, referida a la importancia de la función que cumple el órgano jurisdiccional en el control de la corrección del procedimiento como una forma de garantizar el debido proceso.
