In the field of study of family law, the main achievements had until pre-sent times, been carried out historically in Civil law jurisdictions as part of the work by jurists who specialize in its Private law branch, the same method of categories used in the analysis of private law has been consistently borrowed for this endeavor, however, with the taking several of its closely related issues to constitutional rank, it has since become a necessity to rethink the approaches from which it has been commonly dealt with in order to commune with the current state of the art of Human Rights doctrine.En el estudio de derecho familiar llevado a cabo como labor propia de los civilistas, se ha tomado prestado el método de categorías del derecho privado, sin embargo, al llevarse varios de los temas con lo que tiene estrecha relación a rango constitucional, se ha hecho necesario replantearse los enfoques desde los cuales ha sido abordado históricamente para comulgar con el estado del arte actual en materia de la doctrina imperante sobre derechos humanos.
