This article pretends to justify why a constitutional reform is needed in the subject of children's and adolescent´s rights, a constitutional reform that fits to international instruments, and to the specific theory of this branch of law. Through a brief description of the antecedents of juridical treatment towards infancy and adolescence in the Mexican Constitution, and in international law, it is argumented in favor of the creation of a new lawful frame for children and adolescents. Finally, in order to guarantee the full validity of the Constitutional State for human beings during their first years of life, it is given the basic elements that this constitutional reform should contain.El artículo pretende justificar la necesidad de una reforma constitucional en materia de derechos de niños, niñas y adolescentes que se ajuste a los lineamientos establecidos en los instrumentos internacionales y a la doctrina específica de esta rama del derecho. A través de una breve descripción de los antecedentes del tratamiento jurídico hacia la infancia y adolescencia, tanto en la Constitución mexicana como en el derecho internacional, se argumenta a favor de la creación de un nuevo marco jurídico para niños, niñas y adolescentes. Finalmente, se exponen los elementos básicos que debería recoger la reforma constitucional para garantizar la vigencia plena del Estado constitucional de derecho durante los primeros años de vida del ser humano.
