DescriptionThis article refers to the fundamental right to the water in Mexico; it uses the theory of the constitutional guarantees which is based on the idea of the State as an instrument created by the citizens with the principal idea of better the conditions of life of all persons, the survival of others animal populations and the sustainability of the ecosystems. In reference to the problem of the water, an ample sector of the population in Mexico is having an important discussion over the possibility and the convenience of the fundamental right to the water. This is because the administration and the academy and the society are conscious of the scarcity of this resource and she is in grave peril. The right, and specifically the social and environmental rights seems an instrument capable of collaborate in the construction of this spaces.en-US
DescriptionEl presente artículo aborda al derecho fundamental al agua en México; se aprovecha la teoría del garantismo constitucional que parte de la idea según la cual el Estado es un instrumento creado por los ciudadanos con el objetivo principal de mejorar las condiciones de vida de todas las personas, la supervivencia de otras poblaciones animales y la sustentabilidad de los ecosistemas. Por lo que toca a la problemática del agua, un amplio sector de la población en México está generando un importante debate sobre la posibilidad y la conveniencia de proteger este recurso mediante la constitucionalización del derecho fundamental al agua. Ello se debe a que tanto la administración como la academia y la sociedad han cobrado conciencia de que este recurso es escaso y está en grave peligro. El derecho, y de manera específica los derechos sociales y ambientales, parecen un instrumento capaz de colaborar en la construcción de estos espacios.es-ES
