DescriptionSuccessive amendments to the Cri-minal Procedure Code have increased the scope of application of the faculties of autonomous action of the police, for which it does not need prior order of the prosecutor or the judge. In this paper, in order to demonstrate and evaluate this increase, a systematic analysis of the current configuration of such functions is carried out, trying to distinguish bet-ween those whose expansion has meant a correlative increase in the risk of affecting fundamental rights and those whose widening has not produced that effect en-US
DescriptionSucesivas modificaciones al Código Procesal Penal han incrementado el ámbito de aplicación de las facultades de actuación autónoma de la policía, para las cuales no necesita orden previa del fiscal ni del juez. En este trabajo, con la finalidad de demostrar y enjuiciar dicho incremento, se efectúa un análisis sistemático de la actual configuración de tales funciones, procurando distinguir entre aquellas cuya ampliación ha supuesto un correlativo aumento en el riesgo de afectación de derechos fundamentales y aquellas cuyo ensanchamiento no ha producido ese efecto.es-ES
