This paper aims to explore and discuss the emerging paradigms of the right to the city, fair habitat and the principle of equal protection under a structural perspective, around the situation and social conditions that characterizes vulnerable neighborhoods or slums in Latin America and Argentina. We argue that these new rights approaches, fruits of social mobilization and participation, attempt in a multidimensional manner to account for the complex social reality that affects these neighborhoods and related phe-nomena such as socio-spatial segregation and social inequality in all Latin American cities. Thus, the traditional analytical frameworks about violations on social rights such as fair housing, access to health or education, among others, are weighted in an aggregative and joint way to other more complex and specific social dimensions that are part of the dy-namics of the city. These urban and legal approaches bring novel rules and principles that are slowly permeating the implementation of regulations and public policies in the cities of the region and our country. Este trabajo tiene como objetivo general explorar y poner en discusión los pa-radigmas emergentes del derecho a la ciudad, el hábitat digno y el principio de igualdad de forma estructural, en torno a la situación y condiciones sociales que atraviesan a los barrios populares en Latinoamérica y Argentina. Sostenemos que estos nuevos enfoques conceptuales de derechos, frutos de la movilización y participación social, intentan de forma multidimensional dar cuenta de la compleja realidad social que atraviesa a los ba-rrios populares y fenómenos conexos como la segregación socio-espacial y la desigualdad social presentes en todas las ciudades latinoamericanas. Así, los tradicionales marcos ana-líticos de vulneración de derechos sociales como la vivienda digna, la salud o la educación entre otros, son ponderados de forma agregativa y conjunta a otras dimensiones sociales más complejas y específicas que forman parte de las dinámicas de la ciudad. Estos emer-gentes jurídicos urbanos aportan reglas y principios novedosos que lentamente van per-meando la implementación de normativas y políticas públicas en las ciudades de la región y de nuestro país.
