DescriptionIn the International Law the behavior of de facto agents or non-State entities is not attributable to a State. However, the jurisprudence adopted the concept of “effective control” and “overall control” to attribute crimes committed by members of armed organized groups of a foreign State which supports them to establish the international responsibility of that State and to classify the armed conflict into the International Humanitarian Law.en-US

Sin embargo, la jurisprudencia interpretó las nociones de “control efectivo” y “control global” al resolver la imputación de crímenes cometidos por miembros de grupos armados organizados a un Estado que los apoya a los fines del establecimiento de la responsabilidad internacional de ese Estado y de la calificación del conflicto conforme al Derecho Internacional Humanitario.es-ES
