DescriptionThe paper discuss the disciplinary matrix of the argentinian water law. Based on a critical analysis of the 40’s sistematization of the nineteenth century legislation, the paper proposes to account for the main changes occurred at several levels (theoretical, constitutional, administrative and factual) in order to discuss the way that the principles and assumptions of the discipline must be built nowadays.en-US
DescriptionEl presente trabajo constituye una crítica a la matriz disciplinar del denominado derecho argentino de aguas. Partiendo de una caracterización y análisis de la sistematización efectuada en la década del cuarenta sobre la legislación decimonónica, el trabajo propone dar cuenta de las principales transformaciones acaecidas en diversos planos (teórico, constitucional, administrativo y fáctico) para discutir la forma en que los principios y presupuestos de la disciplina deben construirse en la actualidad.es-ES
