DescriptionThe text highlights the relevance and significant impact of the approval of the Peruvian Constitutional Procedural Code, enacted by Law No. 28237. This Code not only represents a step forward in the consolidation of the constitutional processes recognised in Peru, but is also a pioneering model in Latin America, thanks to its systematic and comprehensive approach. For this reason, the author highlights the improvements introduced by the new regulatory body, with particular emphasis on the processes of habeas corpus, amparo, habeas data, popular action and unconstitutionality. As can be seen, the new Code seeks to strengthen the protection of fundamental rights, as well as a correct control of the constitutionality and legality of the norms that make up the national legal system. Despite its limitations and some undesirable changes, the Code conveys a message of innovation and raises hopes for a more effective judiciary committed to the protection of constitutional rights.en-US
DescriptionEl texto resalta la relevancia y el impacto significativo que conllevó la aprobación del Código Procesal Constitucional peruano, promulgado mediante la Ley N.º 28237. Este código no solo representa un avance en la consolidación de los procesos constitucionales reconocidos en el Perú, sino que también se rige como un modelo pionero en América Latina gracias a su enfoque sistemático e integral. Por ello, el autor destaca las mejoras que introduce el nuevo cuerpo normativo, con especial énfasis en los procesos de hábeas corpus, amparo, hábeas data, acción popular y de inconstitucionalidad. Como se podrá apreciar, el nuevo código busca fortalecer la protección de los derechos fundamentales, así como un correcto control de constitucionalidad y legalidad de las normas que integran el sistema jurídico nacional. A pesar de las limitaciones y algunos cambios no deseados, el código transmite un mensaje de innovación y alienta la esperanza de contar con una judicatura más efectiva y comprometida con la salvaguarda de los derechos constitucionales.es-ES
