This paper addresses the complex relationship between democracy, justice, and due process in the context of the fight against terrorism and subversion that kept Peru in a climate of anxiety during the 1980s and 1990s. It highlights the need to critically analyze whether the laws and judicial practices employed during that period were truly fair and respectful of the rule of law. The author therefore stresses the importance of defending democracy from those who seek to undermine it. However, it is crucial that such protection be carried out with respect for legal principles, the life and integrity of individuals. Consequently, judicial methods must be used that seek the truth and do not violate human rights. In short, it is proposed that the defense of democracy must be carried out within a legal framework that respects democratic principles and human rights, particularly in conflict situations.El presente trabajo aborda la compleja relación entre la democracia, justicia y el debido proceso en el contexto de la lucha contra el terrorismo y la subversión que mantuvo al Perú en un clima de zozobra durante los años ochenta y noventa. Se remarca la necesidad de analizar críticamente si las leyes y prácticas judiciales empleadas durante ese periodo fueron realmente justas y respetuosas del Estado de Derecho. En esa medida, el autor subraya la importancia de defender la democracia de aquellos que pretendan socavarla; sin embargo, es crucial que dicha protección se realice respetando los principios jurídicos, la vida e integridad de las personas, por lo que se debe emplear métodos judiciales que busquen la verdad y no atenten contra los derechos humanos. En definitiva, se propone que la defensa de la democracia debe efectuarse en un marco jurídico que respete los principios democráticos y los derechos humanos, particularmente en situaciones de conflicto.
