DescriptionThis article analyzes the civil liability of the professional and the way in which Italian doctrine and jurisprudence regulate this situation. It is pointed out that the professional activity must be evaluated considering the diligence –of the good father of the family as a general and objective criterion– and the technical expertise of the professional, adapted to the nature of the expected service and the circumstances of each particular case. To that extent, it is important to distinguish between obligations that guarantee a specific result (result obligations) and those in which only technical diligence is required (means obligations), as well as the need for a rigorous assessment of technical competence in situations of particular difficulty. In this regard, there is an evolution in the line of case law by making the rigid distinction between obligations of means and of results more flexible, transferring the burden of proof to the professional to demonstrate his diligence in the face of abnormal negative results that may presume the inadequate or negligent execution of the professional service.en-US
DescriptionEl presente artículo analiza la responsabilidad civil del profesional y la forma en la que la doctrina y jurisprudencia italiana regulan esta situación. Se señala que la actividad profesional deberá evaluarse considerando la diligencia –del buen padre de familia como criterio general y objetivo– y la pericia técnica del profesional, adaptada a la naturaleza de la prestación esperada y las circunstancias de cada caso en particular. En esa medida, es relevante distinguir entre obligaciones que garantizan un resultado específico (obligaciones de resultado) de aquellas en las que solo se exige una diligencia técnica (obligaciones de medios), así como la necesidad de una evaluación rigurosa de la competencia técnica en situaciones de especial dificultad. Al respecto, se advierte una evolución en la línea jurisprudencial al flexibilizar la rígida distinción entre obligaciones de medios y de resultados, trasladando la carga de la prueba al profesional para demostrar su diligencia frente a resultados negativos anormales que puedan presumir la inadecuada o negligente ejecución de la prestación profesional.  es-ES
