DescriptionThis article aims to elucidate the term "social property" as articulated in the Draft Decree Act of Social Property, issued on August 31, 1973, by the Revolutionary Government of the Armed Forces of Peru. Through a dual legal and social science lens, an examination is conducted to discern the concept and fundamental characteristics of property within the legal framework, juxtaposed with the definition of social property outlined in the draft legislation. The analysis reveals that while property is traditionally defined within liberal categories, the conception of social property as delineated in the bill deviates from classical liberal principles, leading to the conclusion that, in a stric sense, it would not be property.en-US
DescriptionEl objetivo del presente artículo es definir el término de “propiedad social” que aparece en el Anteproyecto de Decreto Ley de Propiedad Social, publicado el 31 de agosto de 1973 por el Gobierno Revolucionario de la Fuerza Armada del Perú. Con este fin, se llevará a cabo un análisis desde una perspectiva tanto jurídica como desde las ciencias sociales. En ese sentido se compara el concepto y características esenciales de propiedad dentro del régimen jurídico, y la definición de propiedad social contenida en el anteproyecto. Así, al definirse la propiedad con categorías liberales, se concluye que la propiedad social no encaja dentro de tal concepto por haberse limitado en el proyecto de ley bajo una concepción liberal clásica, por lo que, en estricto, no sería propiedad.es-ES
