Resumen: Este trabajo estudia el fenómeno de la financiación por terceros y su impacto en el procedimiento arbitral en el arbitraje internacional. Tras una descripción general acerca de cómo funciona y una comparación de sus ventajas e inconvenientes, el artículo analiza algunos problemas reales que la presencia de un tercero financiador puede crear y el actual estado de la regulación sobre esta cuestión. La necesidad de un deber de revelación de la existencia de esta financiación y las solicitudes de caución y de asignación de costas, son cuestiones clave que los tribunales arbitrales han de decidir de una manera creciente. Abstract: This article studies the phenomenon of third party funding and its impact on the arbitral proceeding in international arbitration. After a general description about on it works and a comparison of its advantages and disadvantages, the article analyses some actual problems that the presence of a third party funder can create and the current status of the regulation. The need of a mandatory disclosure of the existence of the third party funding and the allocation for costs and security for costs applications, are key issues that the arbitral tribunals are being confronted to decide in an increasing way.
