Resumen: A pesar de la existencia de una normativa comunitaria en materia de seguridad y salud en el trabajo vinculante para todos los Estados Miembros, y a pesar de que el desplazamiento de trabajadores en el marco de una prestación de servicios transnacional cuente con una regulación consolidada, sin embargo, es posible distinguir una zona gris en la regulación de la protección de los derechos laborales en materia de seguridad y salud. De suerte que, independientemente de cuestiones sustantivas referidas a las obligaciones empresariales en esta materia, se observa que hay una asimetría clara entre la regulación comunitaria, y nacional existente, y su efectividad última a través de –inexistentes hoy- mecanismos coercitivos.Palabras clave: desplazamiento temporal de trabajadores, prestación de servicios transnacional, seguridad y salud en el trabajo.Abstract: In spite of the existence of an European legislation in the matter of security and health at work for all the Member States, and although the posting of workers within the framework of a transnational provision of services counts on a consolidated regulation, nevertheless, it is possible to distinguish a gray zone in the regulation of the protection of labour rights in the matter of security and health. In such a way that, independent of substantive issues referred to the enterprise obligations in this matter, it is observed that there is a clear asymmetry between the European and national regulation, and its last effectiveness through - nonexistent today- coercive mechanisms.Key words: posting of workers, transnational provision of services, health and safety at work.
