DescriptionRecently, the First Chamber of the Supreme Court of Justice of the Nation issued a resolution in which it declared the admissibility of punitive damages in Mexican law, in matters of moral damage. However, applying a detailed analysis of the sentence, its arguments and grounds, leads us to the conclusion that this figure has very little in common with the “puni-tive damages” applied in the common law legal systems, and refers only to how to quantify the compensation awarded to the victim.en-US
DescriptionRecientemente, la Primera Sala de la Suprema Corte de Justicia de la Nación dictó una resolución en la que declaró la admisibilidad de los daños punitivos en el derecho me-xicano, en materia de daño moral. Sin embargo, al aplicarlo un análisis detallado de la sentencia, sus argumentos y fundamentos, nos lleva a la conclusión de que esa figura tiene muy poco en común con los “punitive damages” aplicados en los sistemas jurídicos del common law, y se re-fiere únicamente a la forma de cuantificar la indemnización que se otorgue a la víctima.es-ES
