En el actual contexto de crisis migratoria,  el principal desafío al que se enfrentan los Estados europeos es la aplicación coherente de los estándares internacionales de derechos humanos en el sistema inmigración y asilo. Este trabajo propone una retrospectiva sobre la disímil protección del derecho a la unidad familiar de los inmigrantes y los solicitantes de protección internacional que requieren una atención especial, debido a las razones que les obligaron a huir de su país y que les impiden mantener una vida en familia. De este modo, al hilo de dos casos recientes se propone valorar y analizar el alcance de la protección del derecho a la unidad familiar frente a las limitaciones dispuestas ex lege en materia de inmigración y asilo en España. doi: https://doi.org/10.20318/universitas.2017.3561  In the current context of migration crisis, the main challenge facing European states is the coherent implementation of immigration and asylum system according to the international standards of human rights. This paper proposes a retrospective on the dissimilar protection of the right to family unity in cases of migrant workers and asylum seekers that require special attention, due to the reasons that forced them to runaway to their country and avoid them to manage their family life.
