The paper is concerned with the lack of regulation of civil actions in defense of the breeder’s right in Law No. 19342. It critically analyzes the claiming action in favor of the holder of the right in matters of breeder’s right and grants him the ownership of the plants. The nature of the breeder’s right and the purpose of the defense actions are studied. This legal nature is not that of a property right, but is an exclusive power to authorize acts of multiplication of the protected variety. This has been observed since the approval of the current Law. In our opinion, it is not correct to apply copyright and property rights to this matter. The study considers that the gaps in Law No. 19342 should be filled by means of article 106 and concordant articles of Law No. 19039 due to their similarity with patents. The explanatory notes of UPOV and the future legislation in Chile on plant breeder’s rights point to a system of actions different from the claiming action, but similar to the Industrial Property Law.En el trabajo se aborda la falta de previsión de acciones civiles en defensa del derecho de obtentor en la Ley n.º 19342. Se analiza de forma crítica la aplicación de la acción reivindicatoria en favor del titular del derecho en esta materia, otorgándole la propiedad de las plantas reproducidas sin autorización. Se estudia la naturaleza del derecho de obtentor y la funcionalidad de las acciones para su defensa. Dicha naturaleza no se corresponde con un derecho de propiedad, sino con la facultad exclusiva de autorizar actos de propagación de la variedad. Ello se constata desde el trámite de aprobación de la ley vigente. No resulta adecuado aplicar a esta materia el derecho de autor y los derechos reales. Se postula que las lagunas existentes en la Ley n.º 19342 deben integrarse con el artículo 106 y concordantes de la Ley n.º 19039, dada la analogía de régimen jurídico con las patentes. Las notas explicativas de UPOV y la legislación proyectada en Chile sobre derechos de obtentor, señalan un régimen de acciones distinto a la acción reivindicatoria, pero coincidente con el previsto en la Ley de Propiedad Industrial.
