This article reviews the origen of the author right, it historical evolution not only in Chile but also in compared right. To get this, it is approached the rise of this right under the form of real privileges and its development by continental anglo-saxon and european slope. later, the analysis it focused on regulation that ruled in Spain and The Indians and taking care of their reception and development by the chilean right, with special emphasis on the constitutional regulation. finally, the author suggests some disquieting topics about this guarantee.Este artículo revisa el origen del derecho de autor y su evolución histórica, tanto en Chile como en el Derecho comparado. Para ello, se aborda el surgimiento de este derecho bajo la forma de privilegios reales y su desarrollo en la vertiente anglosajona y europea continental. Posteriormente, el análisis se centra en la regulación que rigió en España y las Indias, estudiando su recepción y desarrollo por el derecho chileno, con especial énfasis en la regulación constitucional. finalmente, el autor plantea algunos tópicos inquietantes sobre la expansión de esta garantía.
