Letters of Undertaking (lou.) issued by Protection and Indemnity Clubs have a major role in the present dynamics of the international shipping business. the present study discovers its origin and direct relationship with the P & I Clubs. It details the various objectives sought by their issuance, among which is highlighted the avoidance of the arrest of a vessel or her release. after detailing the possible issuers of these guarantees, it explains the particulars of their granting and the requirements by those who grant them. It explores their legal nature and their recognition within our legislation. the author goes on to mention the benefits offered by the lou. such as low cost, celerity, existence of a variety of patrimonies, ease of modification, avoidance of wrongful arrest, etc. and also mentions the opportunities of their granting. Regarding the standard forms of these guarantees that has been accepted in Chile, the study analyses the property and subjects over which it extends, amounts, interests, commitments between issuer and beneficiary, and the matter of jurisdiction and competence. Finally, the present study concludes with a number of references to the acceptance of the lou. in Chile, their devolution and cancellation, together with some comments regarding the use, trust and prestige held by these guarantees on an international level.Las cartas de garantía o lou.(Letters of Undertaking) emitidas por los Clubes de Protección e Indemnización, tienen un papel fundamental en la actual dinámica del negocio marítimo internacional. en el presente trabajo se descubre su origen y su relación directa con los Clubes de Protección e Indemnización. Se indican los variados objetivos que se persiguen con su emisión, dentro de los que destaca el alzar o evitar el arraigo de una nave. luego, después de señalar quiénes son los posibles emisores de estas garantías, se explican las características de su otorgamiento y las exigencias de quienes las emiten. Dentro de la realidad chilena, se desentraña su naturaleza jurídica y se analiza su reconocimiento en nuestra legislación. el autor da cuenta de los beneficios que reportan las lou., como su bajo costo, rapidez, existencia de una variedad de patrimonios, fácil posibilidad de modificación, evitar el arraigo infundado, etc. y también se refiere a las oportunidades de su otorgamiento. Respecto del contenido tipo de estas garantías que se ha aceptado en Chile, se analiza la propiedad y sujetos sobre los que se extiende, monto, intereses, compromisos entre emisor y beneficiario, y el tema de la jurisdicción y competencia. Finalmente, se concluye el presente trabajo con algunas referencias a la aceptación de las lou. en Chile, su devolución y cancelación, junto con algunos comentarios sobre el uso, confianza y prestigio que tienen estas garantías a nivel internacional.
