From a historical perspective, this article analyzes the background behind the creation of the first special chattel mortgage without conveyance in the Chilean law: the water irrigators’ chattel in the 1908 Act N° 2.139. Also, both the amendment to this chattel carried out by the 1951 CACh — which limited its origin based on the irrigation system— and the 1967-1969 CACh revocation —which annulled it due to its inconsistency with the agrarian reform process— are analyzed. Moreover, this study presents a background to said chattel in the historical period previous to 1908, which helps hypothesize on the existence of a chattel in water irrigators’ ordinary law based on the Civil Code.Este artículo analiza en perspectiva histórica los antecedentes que condujeron a la creación de la primera prenda especial sin desplazamiento del derecho chileno: la prenda de regadores de agua de la L. N° 2.139, de 1908. Asimismo, el autor analiza la modificación a esta prenda efectuada por el CACh. 1951, que limitó su procedencia basado en el régimen de regadío, y su derogación por el CACh. 1967-1969, que la suprimió debido a su disfuncionalidad con el proceso de reforma agraria. Igualmente, este estudio presenta antecedentes de la prenda antedicha en el período histórico previo a 1908, los que permiten hipotetizar sobre la existencia de una prenda de derecho común de regadores de agua basada en Código Civil.
