The changes introduced in the regulation of legal guardianship through the enactment of the Argentine Civil and Commercial Code are positive, since they conform to the social and family reality experienced by children who are protected by this legal framework. However, it is possible to regulate some other aspects that would contribute to strengthen the relationship between the child and his or her guardian(s), as well as to enhance the relationship with his or her environment. This paper will analyse the feasibility of incorporating to the Civil and Commercial Code the need to integrate the minor into the family life of the guardian, the subsidiary maintenance obligation of the guardian and the general rule of unpaid guardianship in cases where there is a kinship or affective relationship between the child and his or her guardian(s).Las modificaciones introducidas al instituto de la tutela a partir de la sanción del Código Civil y Comercial han resultado positivas, pues concuerdan mejor con la realidad social y familiar que experimentan los niños que son protegidos a través de esta figura. Sin embargo, pueden incorporarse algunas cuestiones que facilitarían el desarrollo de la relación entre el niño, niña y adolescente y su/s tutor/es cuando exista un vínculo de parentesco o afectivo previo. Además, coadyuvarían a potenciar y fortalecer las relaciones con su entorno. En el presente trabajo se analizará la posibilidad de incorporar al Código Civil y Comercial la apreciación de la integración del menor en la vida familiar del tutor, la obligación alimentaria subsidiaria del tutor y la regla general de gratuidad de la tutela en los casos que exista relación de parentesco o afectiva entre el niño, niña o adolescente y su/s tutor/es.
