The rights that could be recognized to the unborn child in the classical Roman law were intended not to defend the fetus considered itself in the womb, but rather they were related to other areas, like defense of parental authority of the father or the legitimate hereditary interests. This situation changed in the Justinian law, and mediating the progressive and growing influence of Christianism in the field of law, is thought as defense of the unborn child.Los derechos que se le podían reconocer al nonato en el derecho romano clásico no tenían por fin la defensa del feto considerado por sí mismo en el vientre materno, sino que más bien se referian a otras esferas, como la defensa de la patria potestad del padre o los legítimos intereses hereditarios. Dicha situación cambió en el derecho justinianeo, y mediando la progresiva y creciente influencia del cristinaismo en el ámbito del derecho, se llega a concebir como defensa del nasciturus.
