The core matter the article stands is that the contemporary crisis of the constitutionalism in general and the specific case of the Hispanic American constitutionalism, demands a critical study of its formation and development. This assumption leds the authors to oppose the typical organizational model of the constitutional rationalism to the concrete historic constitution of the Spains, and to compare them through the ideas of order and organization, civic liberties and human rights, societal plurality and pluralism, public religiosity and State laicism, decentralization and power concentration. The article finally suggests that the dichotomy between the public and the private, the transformation of political representation into the Party State, the strengthening of the State linked to nationalism and the lost of the social autonomy because the State sovereignty, can be explained because of the success of the legal and political positivism.    La cuestión capital que el trabajo plantea es que la crisis contemporánea del constitucionalismo en general y del hispanoamericano en particular, crisis por extenuación o agotamiento, obliga a un estudio crítico de su formación y desarrollo. Esta afirmación conduce a contraponer el modelo organizativo típico del racionalismo constitucional al de la concreta constitución histórica de las Españas, comparando ambos a través de las ideas de: orden y organización, libertades cívicas y derechos humanos, gobiernos y Estados, pluralidad social y pluralismo, confesionalidad pública y laicismo estatal, descentralización y concentración del poder. Finalmente sugiere que el triunfo del positivismo jurídico y político explica la dicotomía entre lo publico y lo privado, la transformación de la representación política en Estado de partidos, el fortalecimiento del Estado por la presencia del nacionalismo y la pérdida de la autonomía social por la soberanía estatal.
