This paper analyses the essential aspects of the European regime on unfair terms, marked by the abundant jurisprudence of the Court of Justice in the interpretation of Directive 93/13/EEC. In particular, the scope of application of the regulation, the notions of unfair term and transparency and the consequences of the declaration of the unfair nature of a term are studied.En el presente trabajo se analizan los aspectos esenciales del régimen europeo en materia de cláusulas abusivas, marcados por la abundante jurisprudencia del Tribunal de Justicia recaída en interpretación de la Directiva 93/13/CEE. Se estudian, en particular, el ámbito de aplicación de la normativa, las nociones de cláusula abusiva y transparencia y los efectos ligados a la declaración de nulidad de una cláusula.
