This paper offers an analysis of Habeas Corpus in the Peruvian legal system. For this purpose, three main issues are discussed. First, it tries to establish the nature of Habeas Corpus in Peru. The author points out that, although it is a legal institution whose origin is found in Constitutional Law, it has ended up being used in Civil and Criminal Law. Secondly, the legal nature of this institution is questioned; and in this case, the author tries to reveal whether it is an action or a remedy, properly speaking. Thirdly, the procedural regulation that this "guarantee" should follow within the national legal system is addressed.El presente trabajo ofrece un análisis del Habeas Corpus en el ordenamiento jurídico peruano. Para dicho fin, se abordan tres temas principales. En primer lugar, se busca establecer cuál es la naturaleza del Habeas Corpus en el Perú. El autor señala que, si bien, se trata de una institución jurídica cuyo origen se encuentra en el Derecho Constitucional, se ha terminado empleando en el Derecho Civil y Penal. En segundo lugar, se cuestiona el carácter jurídico de dicha institución; y en este caso, el autor intenta develar si se trata de una acción o un recurso, propiamente dicho. En tercer lugar, se aborda cuál es la regulación procesal que debe seguir esta “garantía” dentro del régimen jurídico nacional.
